Framework Intervention
We act alongside court enforcement officers, judicial administrators, courts and, where applicable, creditors, when the disposal of a vessel must be carried out by public auction within a judicial or equivalent framework.
Public auctions of complex maritime assets are subject to specific constraints: multiple stakeholders, procedural timelines, publicity requirements, technical and environmental risks, and heightened liability for both the seller and the professional in charge of the sale.
Our role is to structure and secure the entire process, both upstream and during the sale, in order to ensure procedural regularity, protection of the parties and the legal robustness of the award.

Asset Typology
We intervene on vessels requiring a reinforced approach compared to standard auctions, notably:

large private or commercial yachts,

passenger or expedition vessels,
-
technically complex or immobilized units,
-
vessels subject to specific constraints (foreign flag, classification, customs status, crew, berthing).
These assets do not fall within a simple standardized sale process.
They require thorough legal, technical and operational preparation, which is an essential condition for the credibility of the sale and the interest of qualified bidders.

Procedural Structuring of the Disposal
Upstream Structuring of the Sale
The sale is prepared on the basis of an in-depth analysis of the procedural framework, notably including:

review of the applicable judicial decisions,

precise definition of the scope of the assignment (sale, support, prior management),
-
securing of the sale timeline in light of the asset’s actual condition,
-
identification of legal, technical and operational risks.
Asset Preparation
This phase notably includes:
-
a technical, administrative and documentary audit,
-
inventory of furniture and equipment,
-
organization of preservation measures and minimum maintenance,
-
coordination with the flag state, classification society and port authorities,
-
assessment of preservation and pre-sale availability costs.
The objective is to present an asset that is clear, documented and legally defensible.

Sale Process
Documentation Package and Bidder Information
The sale is based on a structured and coherent sale file, including:

terms and conditions of sale adapted to complex maritime assets,
-
registration, deposit and screening procedures,
-
organization of strictly supervised inspections,
-
fair, identical and controlled information for all candidates.
Controlled Publicity and Dissemination
Dissemination is organized in a targeted and proportionate manner, including:

a publicity strategy compliant with judicial requirements,
-
controlled outreach to relevant audiences,
-
supervised press communication where necessary,
-
prevention of any over-exposure likely to weaken the procedure.
Sale and Post-Award
We support the operations through to completion:

presence and assistance during the auction,
-
securing of financial flows and escrow arrangements,
-
support for the transfer of ownership,
-
coordination of the vessel’s operational handover,
-
documentary and procedural closing.

Key Considerations
Auctions of vessels present specific risks when conducted without adequate preparation:

lack of market interest due to unstructured information,
-
undervaluation arising from technical or legal uncertainty,
-
post-award disputes,
-
default by the successful bidder,
-
increased exposure for the professional in charge of the sale.
A rushed or insufficiently prepared sale may result in failure, a re-auction or a significant loss of value.
An auction is not merely a disposal method: it is a legally binding procedural act and must be approached as such.
Judicial sales are conducted either at the request of public authorities or within the framework of insolvency proceedings or banking defaults, and rely on close legal and operational coordination.
