Legal Team

The assignments are led by Emmanuelle Votat, auctioneer and Head of the Yachting Department, partner at De Baecque et Associés (Lyon – Paris – Marseille), who has handled the sale of several vessels on behalf of AGRASC.


She has been involved for several years in the management, preservation and disposal of complex maritime assets, within judicial, regulatory or constrained frameworks.

The interventions are carried out by a lean core structure, supplemented on a case-by-case basis by high-level independent experts, selected according to the nature of the asset, the procedural framework and the applicable legal, technical or international constraints.

  • maximum adaptability,

  • and a consistently high level of standards, regardless of the context of intervention.

Procedural Coordination

The direction and coordination of operations ensure:

  • the structuring of the procedural framework,

  • legal and documentary consistency,

  • coordination between authorities, courts, legal counsel and technical stakeholders,

  • strict compliance with judicial decisions and regulatory constraints.

Each assignment is conducted as a legally binding process, rather than as a simple market transaction.

Tax, Customs & Flag

Where required, the interventions include specialists with expertise in:

  • customs regimes and the tax status of vessels,

  • VAT, import/export and release for free circulation,

  • relations with flag state authorities,

  • constraints related to international navigation.

 

This expertise is essential to secure the phases of custody, disposal and transfer of ownership.

             Legal team

Under the responsibility of an auctioneer in close coordination with specialized legal counsel.

The legal team is notably involved in matters relating to:​

  • maritime and port law,

  • collective proc eedings and judicial sales,

  • seizures, confiscations and sanctions,

  • security interests, compliance and post-sale disputes.

This structure ensures legal certainty, enforceability of acts, and effective control of litigation risk.

Legal & Maritime Translation

Cross-border matters require precise, faithful and unambiguous legal and maritime translation.

​

Translations cover contractual, procedural and technical documents.

​

A strict requirement for speed and terminological consistency is applied, ensuring the validity and correct interpretation of the documents.

Technical & Operations

Depending on the nature of the asset, the operational team may include:

  • naval experts and surveyors,

  • mechanical and technical engineers,

  • captains and crew members,

  • specialist contractors in maintenance, preservation and return to service.

 

These competencies ensure:

  • the vessel is brought under operational control,

  • the preservation of its technical value,

  • compliance with flag, classification and safety requirements.

Management

Where the situation so requires, the vessel’s operational management may be entrusted to a specialized management provider, recognized for its rigor and maritime expertise.

Such management covers crew supervision, maintenance, regulatory compliance and operational continuity, within a framework of operational excellence inspired by French standards.
